Personal Injury Claims FAQ
Your questions about making a personal injury compensation claim answered.
How do I know if I have a valid personal injury claim?
You may have a valid claim if someone else's negligence caused your injury or illness. The key elements are: (1) someone owed you a duty of care; (2) they breached that duty; (3) you suffered an injury or loss as a result. Our partner solicitors assess your situation for free and will tell you honestly whether you have a viable claim.
How much compensation could I receive?
Compensation amounts depend on the type and severity of your injury, how it has affected your life and ability to work, and any financial losses you've incurred (medical bills, lost wages, travel costs). Claims can range from a few hundred pounds for minor injuries to hundreds of thousands for life-changing conditions. Your solicitor will give you a realistic estimate of your claim value.
Is there a time limit for making a personal injury claim?
Generally, you have 3 years from the date of your injury to make a claim. However, there are exceptions — for children, the 3-year clock starts when they turn 18. For industrial diseases, it starts from when you became aware of the link between your condition and work. Don't delay — speak to a solicitor as soon as possible.
What is no win, no fee?
"No win, no fee" (formally a Conditional Fee Agreement or CFA) means you pay your solicitor nothing upfront and nothing if your claim is unsuccessful. If your claim succeeds, your solicitor's fees are primarily recovered from the other side. You may also need After the Event (ATE) insurance to cover the other party's costs if you lose — your solicitor will explain this clearly.
Will making a claim affect my employment?
Making a workplace injury claim should not affect your employment. UK law protects employees from dismissal or detriment for pursuing a legitimate personal injury claim. Your employer's liability insurer handles the claim — not your employer directly in most cases.
How long does a personal injury claim take?
Simple road traffic accident claims can often settle within a few months. More complex cases — particularly those involving serious injuries, medical negligence, or disputed liability — can take 1–2 years or longer. Your solicitor will keep you informed throughout and give you realistic timescales based on your specific case.
