RTA Claims FAQ
Common questions about road traffic accident compensation claims.
Can I claim if the accident was partly my fault?
Yes, in many cases. UK personal injury law allows for "contributory negligence" — where both parties share fault. You can still receive compensation, but it may be reduced proportionally to reflect your share of blame. Your solicitor will advise on your specific circumstances.
What if the other driver was uninsured?
If the other driver was uninsured or fled the scene, you can still make a claim through the Motor Insurers' Bureau (MIB). The MIB exists specifically to compensate victims of uninsured and untraced drivers. Your solicitor can guide you through this process.
How long do I have to make a road accident claim?
You generally have 3 years from the date of the accident to make a claim. For children, the 3-year period begins on their 18th birthday. Don't wait — evidence can become harder to gather over time, and witnesses' memories fade.
What if my injuries are delayed — they appeared days after the accident?
Whiplash and other soft tissue injuries often don't fully manifest until 24–48 hours after the accident, or even later. This is completely normal and doesn't affect your right to claim. The 3-year limit runs from when you became aware of the injury.
Can I claim for vehicle damage as well as injury?
Yes. A road traffic accident claim can cover both personal injury compensation AND the cost of vehicle repairs, replacement transport (hire car), and any other property damage. These are typically handled together but may involve different processes.
I was a passenger — can I claim?
Absolutely. Passengers injured in road accidents have the same rights to claim as drivers. If the driver of the vehicle you were in caused or contributed to the accident, you can claim against their insurance. If the other driver was at fault, you can claim against them.
